Reasons to File an Appeal

A driver may appeal a summary suspension of his or her license, a conviction for DUI, or both. An appeal is warranted if an error occurred, such as:

  • The trial court (judge) erred. Did the Court fail to suppress evidence that it should have?
  • The state (prosecutor or police) made an error. Did the state fail to produce evidence?
  • The evidence did not support a conviction.

A trial court may error by failing to properly apply the law, by giving credence to an officer whose police report has been proved unreliable, or conducting the trial in an improper manner.

A police officer commits error by failing to follow state law or procedure. Errors may also result if an officer fails to follow the operating manual procedures that govern the stop, the arrest or the administration of the blood alcohol test.
