Reasons to File an Appeal
A driver may appeal a summary suspension of his or her license, a conviction for DUI, or both. An appeal is warranted if an error occurred, such as:
- The trial court (judge) erred. Did the Court fail to suppress evidence that it should have?
- The state (prosecutor or police) made an error. Did the state fail to produce evidence?
- The evidence did not support a conviction.
